Cowtrain Terms And Conditions

 

PARTY HIRE AGREEMENT   T’s & C’s

The daily rate is R1500.00 per six hour shift plus R250.00 for every extra hour thereafter if agreed to by Cowtrain. The full hire amount of R1500.00 plus a R1000.00 refundable deposit must be paid within 48hrs of receiving a confirmation from Cowtrain or no less than 1 week before the function. The R1000.00 refundable deposit will only be paid back to the client provided that the train does not get vandalised by the clients guests, employees, agents etc and /or the client does not require the services of the Cowtrain after the six hour shift is finished. In the case of fundraising activities ie: fetes, sports days, church functions etc. the client may charge guests a fare for a ride on the Cowtrain and be entitled to the income derived. The client is responsible for ensuring that a proper ticketing system is in place and that the train operator does not handle cash. Cowtrain management will not be held responsible for loss of income caused to the client by our employees. In the event that Cowtrain can not meet its obligations ie: does not pitch up for the function, then the client will be refunded in full without penalties. If Cowtrain arrives at the venue later than the starting time then a portion of the hire amount shall be refunded accordingly or worked in upon agreement between the client and Cowtrain.

 

PARTNERSHIP AGREEMENT  T’s & C’s

In the case of fundraising activities ie: fetes, sports days, church functions etc. the client may choose to pay the full amount upfront ( PARTY HIRE AGREEMENT) or alternatively the client can partner with Cowtrain thereby eroding the risk of loss of income to themselves. In a partnership agreement the first R1500.00 income derived from ticket sales goes to Cowtrain and the balance of the income is split 25% to Cowtrain and 75% to the client. Cash and ticket sales will be managed by Cowtrain management and the client.

 

General T’s & C’s

The train is driven strictly by a trained Cowtrain operator and loading of passengers will be monitored strictly by that operator  only ( the train may not be overloaded ). Please note that free entrance must be provided for at least four Cowtrain employees if there is an entrance fee at the venue. Severe weather conditions ie: rain, snow, sleet, hail etc which would normally prevent the Cowtrain from running does not qualify the client for a refund if it occurs on the day of the function it was booked for. In other words Cowtrain will still appear at the function/venue at the agreed starting time and leave at the agreed finishing time but will only begin operations provided it is not raining, snowing, hailing etc and / or the ground is waterlogged. If the weather conditions prevent Cowtrain from running at all for the duration of the agreed time (6 hour shift ) then the client may not claim a full refund or part thereof if operations were interrupted by weather conditions, breakdowns, vandalism etc. The client must ensure that the terrain is suitable for use by the cowtrain ie: paved walkway, smooth tarred parking lot, soccer field etc. Waterlogged areas and rocky ground are not suitable for use by the Cowtrain as it causes damage to the train and is uncomfortable for passengers. The train operator is required to stop operations for 10 minutes after every half hour of continuous operation in order to have a break ie: use toilets, stretch, drink water etc.
